Rules & Regulations Document Updated

September 20, 2007 | Leave a Comment

The HOA Board of Directors has updated the Rules & Regulations effective immediately.  You can go to the DOCUMENTS section of the website and download or view the new document.

While the following is a summary of changes that have been made, we STRONGLY suggest you read through them to make sure you are aware of all changes.

  1. Change in insurance carrier.  In accordance with Colorado Law SB100, the new insurance carrier and policy numbers for the HOA have been updated to reflect current coverage.
  2. Change in working capital contribution for new owners.  At the August 2007 Board Meeting, the Board authorized an increase in the working capital contribution paid by new owners of homes within the HOA at closing from $250 to $500.
  3. Change in real estate signs that are permitted.  All real estate signs advertising homes for sale and/or lease within the HOA are no longer allowed to be "handwritten".  All signs must be professionally lettered or printed.
  4. Addition of Covenant Lien details for habitual CCR violations.  A paragraph was added explaining that if a homeowner fails to cure a CC&R violation after notification and fines, the HOA will file a Covenant Lien on the property to ensure eventual compliance.  The owner will be charged for the filing costs associated with the lien as well as the costs to remove the lien.
  5. Various adjustments in spelling and elimiination of duplicative rules were also changed.

Foreclosures - Covenant Liens

September 15, 2007 | Leave a Comment

As many of you know, the yards and general landscaping of the homes under foreclosure is not looking good. Right now, all of the homes are far along enough in the foreclosure process that any money the HOA spends to maintain the landscaping of these homes, would probably be unrecoverable.

At our last HOA meeting, our HOA attorney, John Pens informed us of Covenant Liens. These liens are “permanent” on the properties regardless of owners and will help the HOA make sure that new owners quickly fix the issues with the landscaping once they purchase the homes, so that they can have the liens released.

The HOA has filed these liens on 11213, 11238, 11242 and 11244 Decatur Circle.

Individual Fence Painting

Thanks to everyone for painting the fences that are on there private property. As you may remember, the HOA granted an extension to September 1 for everyone to have their fences painted to comply with the HOA CC&Rs. We appreciate everyone taking the time to paint their fences.

11213 Yard & For Sale Signs

August 2, 2007 | Leave a Comment

You may have noticed several for sales signs on HOA property and in the yard at 11213. The owner has been notified that only one for sale sign is allowed and it must be on his property. He has continued to violate this rule and the Board is monitoring and removing the signs as necessary. The owner has been notified that any new infractions will result in a $125 fine.

We have currently levied another fine of $125 against the owner for not removing the weeds, not mowing the grass and not watering the lawn to keep it a lush green color. We will continue to fine the owner in accordance with the CC&Rs, which is $125 every 21 days.

Foreclosures

August 2, 2007 | Leave a Comment

As you know, our foreclosure woes continue in the HOA. A big thank you to Joe & Karen Vance for mowing the yard at 11234 and to Miki Novaria, Pat Jones, Karen Vance, Joan Underwood and Jackie Immele for pulling weeds and mowing the lawn at 11244.

Currently 11244 is due to be purchased by Countrywide Mortgage on August 27 for $704K. Since they are the mortgage holder, we’ll be losing around $2000 on this property. Once the property is foreclosed, then we can refile liens to make sure we’ll collect everything due us starting from the date they take possession.

It appears that 11238 may be selling in the next few days. We’ve received a call from the current owner saying that she has a buyer. She has received a short extension from the lender which has temporarily halted foreclosure proceedings. If this goes through, we should be able to collect everything that she owes.

Foreclosure processing has started on 11234. Right now, the foreclosure date stands for late November. We have received a request from a title company about the amounts due, but it appears that has been no further movement.

11264 Construction Restarted

August 2, 2007 | Leave a Comment

You’ll notice that construction has again started on the vacant lot. The home is due to be completed in November, so you should see an increased number of contractors in the area. We have warned the builder/owner about taking care how the contractors park in the neighborhood. If you’re experiencing problems with blocked driveways or cars parked away from the curb, please call Dave Kinney, our property manager and he’ll contact the owner.

Construction Begins on 11264

June 4, 2007 | Leave a Comment

As many of you can see, construction has begun on 11264. The house is a Como and will be light green in color with white trim and a dark gray slate roof. The house is planned to be owner occupied by the builder.

11213

June 4, 2007 | Leave a Comment

On a somewhat happier note, 11213 has been sold. This house was foreclosed upon in February. While we lost over $2600 on this home, we are hoping to recover the past HOA dues and Special Assessment that occured after foreclosure.

Unfortunately during the foreclosure process, our superlien was missed by the closing title company, so that will now take us longer to collect our dues.
